Large vellum document recording an exemplification of a common recovery of property in Honiton to John Daniel Devonshire against James Hine, tenant. Dated 28th day of November 1814 in the 55th year of the reign of George III. The property consisted of 2 mesuages, 3 gardens, 60 acres of meadow and 60 acres of pasture in the parish of Honiton, Devon. Printed portrait of George III, royal arms and elaborate printed border. Large 10 cm seal (lacking any impression) attached by vellum tag and contained in a round tin. Handwritten on vellum. Some holes in vellum at folds, creasing and minor staining. Text very clear and readable.

A very nice James II indenture recording the sale of tythes and lands in Stockland, Dorset, between Richard Palmer, Elias Booby alias Hoarne, William Downing of Dallwood, Dorset, yeoman, Robert Lidden of Axminster, Devon, Clothier, and John Downing of Stockland, Dorset, yeoman. Dated 19th day of June 1688 in the 14th year of the reign of James II. A very nice, neat indenture from the 17th century document relating to the sale of all tythes and tenths of all corns and other grains, hay, and all other tythable things of what nature or kind given being parcels and tenths of parcels of the Rectory of Stockland in Dorset, and a messuage called Ridge in Stockland. 4 signatures and red wax seals. Very good condition. Handwritten in English on vellum. 23 by 48 cm. Very suitable for framing.

Two page indenture This indenture concerns the will and co heirs of Ffrancis Manaton There are many other people from the area mentioned including William Whitaker, James Young, Dorothy Wynne, Henry Stobell, Samual Lyne and Charles Manaton, who were creditors of a Henry Maneton They went to the High Court of Chantery suing several male members of the Maneton family The document also mentions James Lightburn and a release to Sir William Morice and a messuage and tenement, commonly called Eland (Illand?) Handwritten Copperplate document on handmade laid paper between Edward Leach of Morchard and Thomas Tanner of Bradninch for lease of 2 farms called East & West Billholes and cottages called Kingswell and Greendens plus other lands and orchards in the parish of Thelbridge Condition, whole but tears and holes on folds. Damp stain as shown on seam, back is grubby. This document details the care that is expected of buildings on the estate such as care of thatching, and soil treatments It also states that the "Thrashing Machine" and "Cider Engine" be maintained properly. This Order was served on Stephen Harvey, his wife Love, and their children Stephen and Mary, who'd 'lately intruded' into the parish of St Nicholas.  On examination it appears Stephen was born in West Teignmouth, and since he hadn't gained settlement anywhere else the Order was issued to have the family removed to West Teignmouth.   Order dated 24th February 1720/1, single paper sheet, printed form with manuscript entries.  (ref 185/5)

[Hole Family]  2 Important Hole Documents

As property documents go, these are not especially significant, but they provide important primary evidence of Hole relationships from 200 years ago.   They are:-

1.  A 1794 lease signed by Joshua Hole of South Molton, concerning a house etc called Hole in the parish of Exbourne, and a house called Middlecott in the parish of Broadwood Kelly, both of which were formerly owned by Joshua's great-grandfather, and

2.  An 1854 undertaking signed by William Hole (of Tiverton) to keep safe a collection of mostly 17th & 18th century documents, many of which involve members of the Hole family.

[Broadwood Kelly and Cheriton Fitzpaine]  Mortgage Deeds to Middle Cott and Cheriton Barton

Middle Cott (alternatively known as Middlecoate or East Middlecott) was the subject of a 1795 settlement - presumably long since lost - on the marriage of John Hole and Lydia Arundell.  Together with Cheriton Barton, it devolved to their daughter Lydia Fothergill, who mortgaged the properties in 1869.  In 1877 and 1878 the mortgage was transferred to new mortgagees.  Useful detail on various Fothergills.   The three documents + 1 other (ref 338/2)

[Colyton] Abstract of Title to Property in Nunford

This 1843 abstract gives details of persons involved in various transactions going back more to 1726 when Axminster clothier Joseph Parrett acquired a house etc, land known as Rack Close, The Mead, Souther Wareham, Great Wareham. This was sold to Edward Hooper in 1757, who gave it to his godson Nathaniel Gundry. A second part of the property had already [1746] been acquired by Nathaniel Gundry, consisting of a house and an orchard called Peter's Mead. In 1806 Nathaniel Gundry - then living in Middlesex - sold the whole property to Sir William de la Pole. The abstract also covers a one-fourth share of the nearby manor of Whitford which Sir William de la Pole also acquired in 1806, this having been previously the concern of the Williams familiy. The abstract contains a schedule of tenants of the manor of Whitford, the property tenanted, its area etc. This nice piece of local history is in manuscript on 21 large paper sheets, all watermarked 1842. Though they range in dates from 1862 to 1907 these 3 parchment deeds may be the only property deeds drawn up in that 45 years.  The cottages are described as being near the church in Vicarage Road.  Clearly some building had been constructed during that time as the 1907 deed refers to 5 cottages.  The area was formerly known as Maunders (1862) though the cottage(s) was/were in existence in 1712.  Very much the concern of the Pyne family.  (ref 8/138)

Thurlestone would appear to have been built about 1905, and the original lease and its counterpart both bear site plans showing the property next to the church.   The 4 parchment deeds show Thurlestone was very much the concern of Newton Abbot builder Lewis Bearne until he sold it in 1923.  (ref 8/135)

[Plymouth documents]  2 Property Deeds for Higher Steart [or Stert]

These are all that appear to have survived from a sequence of deeds for 'All that field or close of land called by the name Higher Stert containing by estimation one acre and a half.....situate lying and being within the Borough of Plymouth.....bounded.....by.....the publick road or highway from Plymouth to Exeter on the South.....  The documents comprise the counterpart copy of a 1773 lease for 3 lives, and an 1817 lease for a year at a peppercorn rent - this would almost certainly have been followed up by a release [ie sale], but this is missing.  Both in manuscript on parchment with small seals and marks/signatures.  The pair (ref 273/3)

This is a very large and comprehensive document, which contains a deal of legal waffle, but giving a very detailed outline of the family of  Benjamin Hawkins of the City of Exeter through to his heirs by the names of Welman of Higher and Lower Pondisford and Hawker and their descendants. This journal has a fine red leather cover with gilt decoration around edges, [slight piece missing on spine] It appears to be a collection of poems written by a Nan Keen [inscribed for her grandchildren]. There are 64 sides of poems, on lots of different subjects.Also a couple of dainty pencil drawings and some little prints stuck in. This document opens out to approx 28" x 23".  There are two wax seals and one revenue stamp.

A large 2 page document, includes the sale of one messuage called Fort or Collings tenement with lands, an orchard and lands called Willow Plott, The Broad Park, The Two Grattons, Middle Park, Mowhay Park, Oak Park, Bush Park, East Down and Town Place all in the parish of St Mullion.  Also one messuage called Horsen Hay, 1 herb garden and land called Clance Meadows and Hill Park. Dated Michaelmus Term within 15 days St Martin 1816 in the 56th year of the reign of George III. A large vellum document with a very elaborate top border encompassing a lovely portrait of King George III. 10 cm Metal skippet on vellum tag, with seal inside, but seal broken into 8-10 pieces with no impression. The document shows dust marking. Handwritten in English on vellum with printed elaborate border. 71 by 84 cm.

A vellum indenture recording a deed of covenant and release pursuant to a decree of the Court of Chancery, between George Newbery of New Road, Hammersmith, gent, Robert Michael Baxter and Charles Baxter of Lincoln Inn Fields, Middlesex, gents, Francis Stevens formerly of Sidmouth, Devon, now of St John's Road, North End, Fulham, gentleman and lunatic, John Stevens of Chardstock, Dorset, Samuel Stevens of Axminster, and John Ryle of Waltham Green, Surgeon. Dated 6th July 1843. This large 4 page document appears to relate to the estate of Francis Stevens a lunatic.  St John's Road, North End, Fulham, was given as his present address.  At the time there were two lunatic asylums with addresses on St John's Road:  Norman House & Beaufort House. The indenture is accompanied by an interesting letter from John Newbury to John Stevens:

I have this day renounced my claims under your late brother Francis' will and I now beg to offer you my congratulations, for you must be gratified by dispossessing his friend and adopted heir of his intentions. The assumption throughout has been that he had no right to dispose of what was his own. I wish you every enjoyment of your righteous possession and sincerely hope that you may have as much enjoyment in the possession as I have in the deprivation. I am Sir, your humble servant George Newbery."

Fascinating original Will of a Yeoman (George Filmore Field) in Broadlist, Devon dated 26th March 1809 together with Codicil dated 9th Nov. 1809 and Probate attached dated 1st Nov. 1811. The Will and Codicil span 5 pages together and the Probate with ancient seal is attached to the front of these.  I purchased this some years ago whilst holidaying in Devon as one of my ancestrial names is Field.  Have had great pleasure deciphering it ever since (used to work in the Legal business)!!  Mr Field was unable to read - write and therefore his signature is a X.  His main benefactor was his eldest son, another was left £8 per annum and his wife just £3 per annum plus £4.00 for a suit of mourning!!!!
