Unusual
Group of 3 Antique Legal documents relating to property in ‘Claxton otherwise
Little Claxton’ in North Yorkshire. One of the owners of the property appears
to have been resident on the Island of Madeira at the time of a transfer of
ownership of the property. The documents here appear to relate to the
appointment of Special Commissioners in Madeira who could confirm that the
owner understood the implications of the Sale etc. One of the documents bears
the signature of a Knight and Justice of the Court of Westminster. Document
1) Deed of
Appointment at the Court of Common Pleas, of EDMUND ELLICOTT (Merchant) and
WILLIAM HINTON both of the Island of Madeira as SPECIAL COMMISSIONERS. This
Document is signed by SIR RICHARD BUDDEN CRUNDEN (Knight) one of the Justices
at the Court. This is a Waxed Deed dated 14th January 1856 and bears an
Enrolment Stamping and relates to the taking of an acknowledgement by MARY
ANN LUND, the wife of DR GEORGE LUND (Doctor of Medicine) owners of the
property in Yorkshire, although both were resident on the Island of Madeira
at the time. Document
2) Sworn
affidavit by EDMUND ELLICOTT witnessed by GEO. STODDAY (Her Majestys Consul
for Madeira) dated ‘Funchal’ 24th January 1856 certifies that MARY LUND was
of full age and competent understanding etc. Document bears the British
Consulate Madeira Stamping. Document
3) ‘Commissioners
Certificate’ and acknowledgement signed by EDMUND ELLICOTT and WILLIAM HINTON
relating to an Indenture made between JOHN SINGLETON and JAMES RICHARD
SINGLETON, BARNARD JAMES BOULTON. GEORGE LUND , MARY LUND, HENRY GARBURGH
GOLD AND ELEANOR GOLD, JANE PHIPPS AND WILLIAM AND GEORGE GOTHORPE (relating
to property in Claxton in Yorkshire) dated 24th January 1856. Note –
William Gothorpe appears to have owned property in Earswick Yorkshire and
lived at 19 Monkgate. York. These are an unusual group of documents, may
appeal to those with a local history interest in Yorkshire or the Island of
Madeira. These documents date to a period towards the end of the Crimean War.
Some research may explain why Dr & Mrs Lund were in Madeira. It is interesting
to note that the ‘post’ from Westminster to Funchal took less than 10 days.

"An Act for making the River Dun, in the West riding of the County of

the making and continuing the River Dun, in the West Riding of the County of
York, Navigable, from holmstile in Doncaster, up to the furthest Extent
Westward of the township or Lordship of Tinsley, will be very Beneficial to
Trade, and Advantageous to the Poor, a great Incouragement to the Manufactures
of Iron, and convenient for the Carriage of Lead, Coals, Lime, Stone, Timber,
and other Goods, Wares, and Merchandizes, to and from the Towns and Parts
adjacent, and to and from Derbyshire, Cheshire, Lancashire, and other
Counties to and from London, and several other Parts of this Kingdom, and
will very much tend to the imploying and increase of Watermen and Seamen, and
be a Means to preserve the Highways, and whereas the Master, Wardens,

belonging to the Garth family who also owned a great deal of land in what was
then Swaledale part of Yorkshire.These documents disappeared many years ago
to be unearthed at a local auction.Having been on loan to a museum they now
can be sold.The indentures,Wills,personal letters,court acts,divorce etc
provide a rare chance to really understand the area in the time we were still
fighting the Scottish.The documents(102)some on vellum but startring from the
early 1600 and perhaps earlier show a span of 200 years with a lot of the
items belonging to the 1650 to 1750 period. |

This is
a one off unique legal document dated 1886 pertaining to an estate in York,
England. First let
me tell you that I am no expert in this field, but I will do my best to
describe the document as accurately as possible! Written
in fancy writing the document measures 22.5" X 26" and is made of
what I believe to be either waxed paper or vellum which is semi-transparent
when held against a light. I am not good at reading this style of writing,
and while 100% of the writing is clearly readable I cannot decipher the
words! So bear with me and I will do
my best! Words that I cannot make out I will * next to. This
document had details on both sides, so not to confuse you anymore than I can
avoid I will call the front side A and the back side B! The
large writing at the top of the document (side A) reads: "A Memorial to
be registered at the Land Registry in England pursuant to the Improvement of
Land Act 1864 of An Order......." then writing then gets smaller and
there is a lot of it! This side of document has an official red two shillings
and six pence stamp, which has silver metal the crown part (on sideB of the
page is a black stamp with the crown and letters VR* which seems to seal in
the silver metal on to the stamp on
side A). The stamp on (side A) and has the crown at the top and is size 1¾” x
1¾” approx As to the document content, as I said I am no expert, but
it appears to be concerning the land/estate of The Mayor Alderman and the
Burgefses* of the Borough of BLACKBURN.
It seems that The Mayor owned a considerable amount of land in the
West Riding area of the county of York. These lands are described on the
document (side A) as: "Such portion of the following farms" Brennan*
Whitendale* Beatrix* Wood End "and other lands as are coloured red and
green on the plan hereunto annexed". On the (side
B) of the document are 4 maps/plans (see photos) these plans for the parish
of Slaidburn, include lands also belonging to the major which are detailed
as: The areas of Costy Clough and Whittendale River, Dunsop Houses,
Sheepfold, Part of Holme Head Wood, Lands surrounding and including the
Brennand River The
scale of the map reads as 1 inch -90. Statute Chains! One of the maps has a
legend/key which says Land for road coloured green and some other letters and
numbers and Land for Wells or Tanks at W.X.Y.Z. Side A seems to be concerning
the Improvement of Lands act 1864 and the sighting of new wells and roads for
the area but I am really NOT sure! It is signed by the Solicitors to the
General Land Drainage and Improvement Company, but I can not decipher the
signature! What ever the context of
the document it is original and in good condition for its age, with the
exception of being very stiff , from being folded up for 119 years! (some of
the folds are a little dirty and there is a tiny hole appearing in one of the
folds). There are some pencil marks on
the document as to their nature again, I do not know. There is some pencil
numbering in the top left corner and some other wtitting dotted around! No
doubt it was an official from the Office of the Land Registry! When the
document is folded the back has signatures of witnesses? |

English vellum indenture dated 1761 during the reign of George III being the
conveyance of a dwelling in Kirklands in Baildon in the County of York
including a shop between Martha Marshall, a Widow, of the one part; and
William Bolling, a Gentleman, of the second part. Nicely penned with fancy
printed vignette, blue revenue stamp with insert, tax stamp, and official
docket. Red was seal with armorial impression on cloth tag. Very Good
condition with some discoloration, measures 19.5 x 13". |

two page vellum indentured dated 28th September 1872 relating to property in Heeley,
Sheffield (with machinery) between Thomas Credland and James Thomas Sydenham,

Handwritten
English vellum deed dated 15 April 1342 during the reign of Edward III being the
conveyance of a dwelling and land in Rughlay and Lepton in West Riding in the
County of Yorkshire (near Huddersfield). The deed is accompanied by a
complete translation into English from the Latin. Following the translation
is background on the Fleming family. The document is between Thomas le
Flemyng to Robert Talevace and his wife Beatrice. Legible throughout with
hole concealed by gutter and intruding into one wrd at bottom. Vellum seal
tag lacking seal. Measures 10 x 3.75". The transcript reads: "Be it
known to all present and future that I, Thomas, son of John le Flemyngh of
Dalton, have given, conceded and by this my present document confirmed to
Robert Talevace of Rughlay and to Beatrice his wife, one messuage and all my
other lands and tenements in Rughlay within the boundaries of Lepton, which I
recently held by grant and concession of John, son of John of Rughlay, in the
same village, to have and to hold the aforesaid messuage along with its

INDENTURE (Counterpart of Assignment of Lease) about ROTHERHAM NO RESERVE
This indenture on vellum was made on the !st August 1757 and is between
Samuel Hallows Hamer of Rotherham of the one part and the Right Honourable
Thomas Earl of Effingham of the other part. (This was the second Earl of
Effingham who also served as Deputy Earls Marshal of England from 1743 to
1763.)The deed concerns a property in Rotherham. There is a blue revenue
stamp at the left and, at the foot of the document, the signature of the Earl
alongside his seal in red wax. Size. The document is approx. 28" wide x
24" high. Condition. In excellent condition with the usual folding
creases. |
