A set of two vellum Indentures, both dated 1775. Both Indentures are overall in very good condition. The first Indenture, with two seals to the bottom is dated 19th December 1775. It measures 43cm x 33cm, 17in x 12.5in The second, with three seals  to the bottom is dated 20th December 1775. It measures 82cm x 57cm, 32in x 22.5in. Both the indentures are leases for the same house, as shown in the pictures. The leases are between William Bawden of  stonegap, in the parish of kildwick and county of york, and the other person is Peter Barett of tarn hill, also of kildwick, york. One indenture is for a years lease, and th other is for a release. Both indentures also have a stamp for king George III.

Mortgage on a piece of land in Leeds. A book keeper named John Stephenson Emery is borrowing a mortgage from a mechanic named James Gavins (or Cavins?).The money is to be used to buy a plot of land in Hanover Street in Leeds.The document is dated 1st July 1867. The large one page (30" x 23") has the details of the agreement handwritten on the parchment paper.The two men involved have both signed and red waxed sealed. The antique item is in very good condition,complete with the Victorian duty stamps.

Tithe Rent Charge from Tickhill in South Yorkshire

The landlord is F.J.S. Foljambe (Right Hon.) and the recipient of the charges is a Mr.William Foster (although the land owners name seems to be Nicholson) and these charges were collected on behalf of the landlord by a C.W. Lister Kaye,arranged collection place was at the Scarbrough Arms Inn (still an active pub). Revenue stamp thats still in excellent condition.

Probate of the Will of Sarah Fieldhouse dated 28th April 1866. Probate of the Will of SARAH FIELDHOUSE of Providence Place, Back Lane, Bowling in the Parish of Bradford in the West  Riding of Yorkshire (Spinster). The Probate is granted by the Wakefield District Probate Registry to GEORGE FIELDHOUSE, has the Probate Registry Seal attached to it and is signed by J. BAILEY LANGTHORNE, District Registrar. The Probate has a handwritten copy of the Will dated 14th March 1859 (on a single sheet measuring approximately 61 x 45 centimetres) attached. It appears that Miss Fieldhouse and one of her witnesses were unable to write and both made their mark with a "X". The documents have the usual creases where folded but, bearing in mind their age, are considered to be in a good, clean condition.

Jolby.  Charter, grant from Henry, son of Alan de Joleby to his brother John, making a gift of a toft and croft “between my toft and that of Henry, son of Hugh, and two acres of land in Jolby”,  witnesses: “Alexander of Cleasby”, “John son of John of Croft” and 5 others, manuscript on vellum, in Latin, 10 lines, stained but text clearly legible, folds, lacks seal, 77 x 212mm.,  [c. early thirteenth century].

The Manor of Jolby. “In 1286 Roald de Richmond was lord.... . From him it passed to the Scropes of Bolton, who held it until the time of Richard of Clervaux. From this time, Jolby, which is not even a hamlet, has no history, but it was probably acquired by Richard de Clervaux, and always descends with the manor of Croft... .” - Victoria County History, Yorkshire, North Riding.
“Personal names introduced into England during the Middle English Period are also found compounded with Scandinavian by ‘farm, village’. This type of compound does not occur in the Midlands, and is rare in Yorkshire where, however, there is Jolby (NRY) from Johel, i.e. Joel.” - Cameron. English Place Names.

Vellum Indenture by way of Conveyance dated 1st October 1874. PARTIES - JOHN KAY (Gentleman) of Ilkley in the County of York (1) and HENRY JAMES COOKE (Merchant) of Bradford in the County of York (2). PROPERTY - Two closes of land in Ilkley - The North Ewe Croft containing 6194 square yards and the South Ewe Croft containing 1025 square yards. PURCHASE PRICE - £2,635. 11s. 9d. Other names mentioned : WILLIAM HAWKSWORTH, JOHN HAWKSWORTH, THOMAS THOMPSON, CUNLIFFE LESTER, HENRY JAMES COOKE.

This is a substantial document consisting of two pages of approximately 69 x 58 centimetres. The first page has two blue duty paid stamps in one strip. On the reverse are the signatures of H. F. KILLICK, Solicitor, Bradford, J. H. HARDAKER, Clerk with Wood & Killick, Solicitors, Bradford and another which is indecipherable as witnesses, a receipt for the purchase price, an acknowledgement for delivery of documents and a memorandum of registration of the document at Wakefield. The second page has a plan of the property, two red sealing wax seals and the signatures of the parties.

Attractive vellum deed, ca 190 x 325 mm (7½ x 13 inches), tag with red wax seal, 20 August 1552. Leasing a wood, the property of Francis, Earl of Huntington, in the lordship of Hal'by [Haldenby? Yorkshire?], lately occupied by the Parson, to Richard Pytman and his sons for their lives and to the one who lives longest successively.
Signed by Edward Hastings, 1st Earl of Huntington, John Ascot and William Belson. Inside the fold is a note by the 'Commissioners', giving power of attorney to James Day to make delivery of seisin (possession or the symbol thereof) to Richard Pitman, the father and Hugh and Richard Pitman, the sons.

Cleckheaton Lease for a Year 1802

 A handwritten Indenture comprising a Lease for a term of one year dated 9 December 1802.  The use of a Lease followed by a Release the next day was standard conveyancing practice at the time to avoid the requirement of seisin which meant there had to be physical entry on the land to complete the transfer of title.

The property in question is a newly erected barn with a chamber or granary adjoining, a further dyehouse, vacant ground and meadow called ‘Pighill’ at Rawfolds, Liversedge, in the Parish of Kirkstal, Yorkshire. This area is now Cleckheaton.

Typed Extract of Roundhay Manor / Seacroft Deeds (1837-1890). Location: Numerous properties in Seacroft in the Manor of Roundhay, Leeds, Yorkshire.

History: William the Conquer originally granted the manor and park of Roundhay to Ilbert de Laci in the latter part of the 11th century. By 1294 it was still held by Henry de Laci but his only child and heir was Alice who was married to Thomas Plantagenet, Earl of Lancaster and thus was incorporated into the Duchy of Lancaster. However Thomas the earl of Lancaster was beheaded at Pontefract in 1321. The earldom then passed to his nephew Henry and following his death a partition of his estates was made in 1361. This partition saw Roundhay pass to Henry’s daughter Maud, wife of John of Gaunt, Earl of Richmond and then later Duke of Lancaster. Their marriage produced a son named Henry Bolingbroke who took by force the English crown from Richard II and became Henry IV in 1399. From this date Roundhay became a Royal Manor and remained so until June 1629 when it became the property of the City of London, six months later it was bought by Stephen Tempest, a Captain in the Kings Army for a sum of £850. In 1653 following the Civil War and the defeat of Royalist forces, Parliament confiscated the lands on grounds of Treason against the Commonwealth. Parliament then sold the manor of Roundhay to William Lowther. The manor then passed to William’s nephew Sir John Lowther who then sold Roundhay to John Savile of Methley in 1688. Roundhay remained in the Savile family until 1804 when the then John Savile second Earl of Mexborough assigned the manor along with other estates to several trustees who were empowered to sell the lands. Thus in November 1811 Thomas Nicholson purchased Roundhay.

Information includes types and uses of different buildings, measurements and acreage of land, full boundaries to properties in relation to streets and owners of neighbouring property and names of past and present owners and tenants along with other details. Overall there is a wealth of historical information about Seacroft and the typed nature of the document without the technical legal phases makes it easy to understand.
 
Document: On strong paper it remains in excellent condition. Typed in English the words are clear and easy to read. On a total of seven pages, each page measures approximately 12 ½ inches by 16 inches.

The document closes with the rights and legal obligations of the persons involved along with the terms and conditions of the lease that are in fact factitious as this was in fact the first of a two-part sale of the property.

Document: On vellum it remains in excellent condition, the hole on the second leaf being a natural knothole in the vellum matrix. Written in English the words are clear and legible throughout. On two leaves the largest leaf measures approximately 28 inches by 25 inches. Indented along the top there is nice calligraphy at the start of the document. On the left of each leaf are three blue duty stamps with a piece of silver attached and at the base are nine signatures with red wax seals displaying a Coat of Arms. On the reverse there is a little more writing and several other signatures of persons concerned.

Contents: This indenture is a release i.e. sale of the property described above. Whereby the others are selling the property to Read. This was the second part of a two-stage process of conveying property, please see last paragraph. Details about the persons involved are given including their family history along with the amount of monies exchanged. Information is provided about the property including acreage and names of past tenants. The document closes with the rights and legal obligations of the persons involved.
Document: On vellum it remains in very good condition, but having some discolouration due to age and with a couple of minor holes. Written in English the words are clear and legible throughout. On a single leaf it measures approximately 32 inches by 25 inches. Indented along the top, on the left are three blue duty stamps with a piece of silver attached. To the base are signatures with four red wax seals displaying the head / bust of a man. On the reverse there is a little more writing and further signatures.

Hawkesworth or Hawksworth Family (of Hawksworth Hall, near Guiseley, parish of Otley, West Yorkshire) [Extensive archive of papers and documents relating to the Hawksworth Estate in Menston and other properties elsewhere in Yorkshire and Lancashire], manuscripts, documents, correspondence, including numerous medieval charters, many with wax seals, most extremely well preserved, 16th - 19th century indentures and estate correspondence, surveys of land, numerous receipts, auction catalogue of sale of the estate in 1955 etc., many on vellum, some in wrappers of The Thoresby Society dating from the 1930s, folds, some browned and with tears, most in good condition, in a remarkably good state of preservation, housed in two tin deed boxes: "EL Gaunt Hawksworth Papers", v.s., v.d., thirteenth - twentieth centuries (qty).

The Hawkesworth family are said to be descended from one of William the Conqueror's commanders, killed at the battle of Hastings, with the estate being gifted to his son. More certainly, while they appear to have had a small estate at Hawksworth, at least from the twelfth century, it was not until a Walter Hawkesworth married into the Ward family did the Hawkesworths become the paramount landowners in the area. An older house was known to have existed on the site, but the present building was begun in the early seventeenth century, the oldest part with a datestone of 1611. During the Civil War, Sir Richard Hawkesworth, a firm ally of Sir Thomas Fairfax was arrested at Hawksworth Hall and imprisoned at York until the city surrendered in 1644. A little later in the same century Sir Walter Hawkesworth, created a baronet in 1669, made several alterations to the house, and there are further dates of 1664 and 1667 on the chimneys. Hawkesworth was briefly involved in national affairs during the 1660s when in correspondence with George Villiers, second duke of Buckingham, who was attempting to establish a power base in West Yorkshire. Apart from his own extensive holdings in the county, Buckingham married Mary, the daughter of General Sir Thomas Fairfax who had a house in the village. Hawkesworth's letter-book cum commonplace book is included in this archive. Alterations continued to be made to the house until the eighteenth century when in 1796 Frances Fawkes of Farnley Hall, near Otley, died and left all of his property to Walter Ramsden Beaumont Hawkesworth (art collector, 1769-1825), who had married a near relation. He took the surname Fawkes and went to live at Farnley Hall. The Hawkesworth family retained ownership of the house but ceased to live in it after 1825 and for the remainder of the century it was let to tenants. Later, it came into the possession of the Gaunt family, who, in 1955 sold the estate at auction. Until recently, the house was used as a school by the charity SCOPE, treating children for cerebral palsy. The school was closed in 1998 and in 2000 was sold. In addition to the longevity of the Hawkesworth family themselves there are at least two families with a remarkable continuance in one place, notably the Roodes or Rhodes family (perhaps several families all taking the same surname, there is an area of the village known as High Royds today) and the Vavasours, both of yeoman stock and both mentioned in early medieval charters and stll mentioned in accounts until well into the eighteenth century.

Menston is a village near the towns of Guiseley and Otley in Lower Wharfdale, West Yorkshire. Recorded in the Domesday Book in 1086, Menston is described as being in the Wapentake of Skyrack, being part of the manor of Otley. During the medieval period ownership of much of the village came under the control of the Hawkesworth family through marriage with the Ward family. This is reflected in the large quantity of deeds from this period, relating to every aspect of legal ownership of property in an agricultural economy. Thereafter the Hawkesworth's hegemony over the area started to wane, though they retained a presence until the late nineteenth century. Menston remained a largely agricultural community until the eighteenth century when, in common with much of West Yorkshire, the process of industialisation through the operation of the mills began. Despite this, Menston remained a small community until the nineteenth century when a flax mill and two woollen mills were established to the west of the village and numbers correspondingly rose. One of these mills later became a linen bleaching mill. In 1865 work began on the railway and in 1887 the Fawkes family sold land, upon which the local hospital was built. The twentieth century, of course, as in every other part of England has seen a continuous rise in the population and concomitant house building.

Beatrice Ward (d. 1281), married Walter Hawksworth in 1273; her dowry being the Hawksworth estate. Her ?nephew, Simon Ward was sheriff of Yorkshire in 1316 and supported Thomas, earl of Lancaster in the baronial opposition to Edward II. In 1321 he changed sides in favour of the king and his new favourites, the Despensers. In 1326 he was made captain of Pontefract Castle and received numerous gifts from Edward II.

Byland Abbey was one of the most famous Cistercian foundations in England, along with Fountains and Rievaulx Abbeys. Originally founded as a Savignac house in 1134, it was brought within the Cistercian community after the Savignac movement was absorbed by them in 1147. The abbey became wealthy on its rearing of sheep and the export of wool. At the Dissolution the abbey was valued at £238 9s 4d.

Henry de Lacy was one of the most important barons of his age and a life long supporter of Edward I. He served with the king in the Welsh wars and subsequently nearly every other theatre of warfare during the reign, as well as numerous diplomatic missions. In 1295 Lincoln was appointed king's lieutenant in Gascony and served until 1298, having fought in France during that time.

In 1657 "Buckingham returned to England and paid suit to Mary Fairfax (1638-1704), daughter and sole heir of Thomas, Lord Fairfax, the parliamentarian general. Mary, smitten with the duke, broke off her engagement to the earl of Chesterfield, and Buckingham and Mary were married on 15 September at Bolton Percy in Yorkshire. As Fairfax had been granted the major portion of the duke's confiscated estates, the marriage was a blatantly opportunist move to secure his inheritance." (Oxford DNB). As Fairfax had a house at Menston, Sir Richard and his son Walter Hawkesworth could be counted as near neighbours and Sir Richard was arrested and sent to prison in York over his support for parliament during the Civil War. On 30 October 1661 Buckingham was appointed lord lieutenant of the West Riding. "The West Riding lieutenancy had attached to it more deputies than any other county, and therefore promised Buckingham extensive local patronage. Within months he had created a loyal clientele of youngish, politically inexperienced deputies, among whom was Sir Thomas Osborne (later earl of Danby) and George Savile (later marquess of Halifax) were to advance furthest. The duke's first chance to advertise his abilities, and to expunge the republican taint that his return to England in 1657 had created, occurred in autumn 1663, when news reached London of a major republican conspiracy in Yorkshire. The duke journeyed to York, and requested a commission to raise a horse regiment. This was unduly alarmist, since government spies had already infiltrated the claques, but three rabble-like gatherings of dissidents did take place on 12 October, and this appeared to vindicate his caution. He was instructed to oversee the prosecution of the ringleaders, and some twenty men were hanged in Yorkshire early the following year." - Oxford DNB.

James I (King of England, Scotland and Ireland, 1566-1625) Letters Patent to Robert Dighton and Francis Wolley relating to Benningholme, near Hull, D.s. "Fran: Wolley" & "Jo: Stanley", manuscript in Latin, remains of wax seal, a few small tears along folds, folds, 372 x 540mm., 11th July 1609.

Francis Wolley of Pyrford, Surrey is chiefly remembered for having given a home to the newly married John Donne and his wife Anne.

Charlton (Lionel, Land Surveyor at Whitby) An Accurate Survey and Plan of the Battel-Banks near Ugglebardby [Ugglebarnby ], as they were divided between Messieurs, John and Adam Chapman in the Year 1777..., pen and ink and watercolour wash in outline map on vellum, red wax seal in corner, folds, slightly foxed, 450 x 340mm., 1777. From the image the full text reads: "An accurate Survey and Plan of the Battel-Banks near Ugglebardby, as they were divided between Messieurs John and Adam Chapman in the year 1777 by Lionel Charlton Land Surveyor at Whitby. " The map shows the owners of the adjacent land as John Wood senior, John Wood junior and Messieurs Howlett and Mathews. I have saved a copy of the image.
