A most interesting
English vellum deed dated 1850 along with several related papers pertaining
to what appears to be a foreclosure on a fine dwelling on Holme Island in the
Palantine of Lancaster. To further add to the intrigue is several references
to a stash of wine held by the debtor in his house on Holme Island and in the
posession of Joshua Penny and Company. Wine Merchants of London. Some of the
papers are of the Wine Merchant. The deed is between John Thompson who
appears to be the debtor who currently resides in Calais France, an Esquire,
of the first part; and William Feetham Miller of Middlesex, an Ironmonger,
and William Shaw, a Gentleman, both of the second part. Five vellum leaves
with five blue revenues and tax stamps, and three red wax seals on green
cloth tags. An addendum is penned on the verso of one leaf with stamps and
seal. Approx 35 papers, mostly receipts, not examined still with old pink
cloth tie. Very Good, some mild creasing, measures 27 x 21". |

RIVETING,REVEALING,ROLLICKING
READ: these original documents from 1795 to 1806 reveal the extraordinary
case of a family of solicitors locked in legal battle over the conduct of two
of the family regarding their executorship of Mrs Mara's will. The
accusations are serious and detailed. This could be the basis for a novel of
the period but as is often remarked: 'Truth is stranger than fiction'.
However if this batch does not sell I am tempted to write this up as a novel
myself! # Letter addressed to Samuel Johnson, Lincolns Inn from Langhams

HILLSBOROUGH
(Trevor Hill, 1693-1742, M.P., and his wife Mary, 1684-1742, from 1717 1st
Viscount and Viscountess) 4-partite Indenture, signed, on 3 large skins, also
signed by Richard Hill of Hawkstone, Shropshire, and John Bennett, Master in
Chancery, whereby Bennett pays Richard Hill £2,195 17s 10d for the remainder
of the 91-year lease on the house and "corner peice .. of Ground .. on
the West side of Hannover Square", formerly part of "Millfield
alias Kirkham Close .. abutting .. South on a new intended street called
[blank] Street" (now the East end of Brook Street, Mayfair), where Lord
Hillsborough is building a house, the lease to run from 25th March 1717 at
the yearly rent of a peppercorn, engraved royal arms, 3 sides vellum 30"
x 39", joined at foot by linen seal tabs, receipt and note of
registration on verso of first side, n.p., 9th June 1724, The four parties
are (1) Richard Hill, (2) Lord and Lady Hillsborough, (3) Sir John Werden,
2nd Bt., of Holyport, Berkshire, and (4) Master Bennett, to whose name that
of his colleague Martin Killigrew has been added, though Werden and Killigrew
have not signed. The document gives the history of the site from earlier indentures
of 1717 and 1719. It appears that Nicholas Dubois is either the freeholder or
chief lessee. 1717 Lord Hillsborough paid the 1st Earl of Scarborough £150
for a 33-year lease from 25th March 1717, and Joseph Jolly of London Stone,
merchant, £110 for a further 59 years from 25th March 1750. Lady
Hillsborough, widow of Sir Edmund Denton, Bart., of Hillesden,
Buckinghamshire, had received £8000 as her marriage settlement to Lord
Hillsborough, and now directed that her husband should use half to build a house
on the site, in trust for her and their children. Initially the lease was
transferred to Alexander Denton of Hillesden, the judge, and Edmund Dunch,
(M.P., 1657-1719, a member of the Kit-Cat Club). By June 1719 Lord
Hillsborough had to borrow a further £2000 from Samuel Hill of the Inner
Temple, acting for Richard Hill, which he secured by a conditional conveyance
of the lease. Although Lord Hillsborough could not find £2100 by the early
redemption date, the property had increased greatly in value by 1724. John
Bennett was settling the estate of Sir John Werden, 1st Bart., a great part
of which "did consist in South Sea Stock Bank Stock and India
Stock", and by court order of 13th March 1721/2, Bennett was given
control of these and found he had £12,000 to invest. Looking round, he
"conceived the same [Hanover Square property] to be a good security for
£12,000". He therefore negotiated to take over the 91-year lease, and by
the present document pays off Richard Hill in full. He receives the remainder
of the lease on trust for the 2nd Bart., subject to a right of redemption by
the Hillsboroughs, as detailed in an indenture due to be signed the following
day, 10th June 1724. The plot of land measures "50 feet of assize"
from North to South, being 116 feet on the North Side, and 111 on the South.
Lord Hillsborough had been an M.P. in the Irish parliament, 1713-1717, and
after receiving an Irish peerage (21st August 1717), transferred to the
English Commons as M.P. for Aylesbury (1717-1722). The first indenture
recited, of 3rd April 1717, refers to the couple as Trevor and Dame Mary
Hill. Their son became the 1st Marquess of Downshire. Sir Richard Hill, 1st
Bart. of Hawkstone, was for many years paymaster to the army in Flanders, and
ambassador to Brussels and Turin. He died unmarried in 1727, aged 73, and
does not appear to be a relation. |
