Vellum Indenture - 1886 Deed - Blakemere, Herefordshire A vellum Indenture on four sides of folded vellum measuring 22 cm x 29cm approx The main document is dated 13th August 1886 between Martha ELLIOTT of Blakemere, Herefordshire and William JENNINGS of Church Street, Hereford and is a Mortgage for £10.  There are various endorsed Indentures on the document between the same parties dated 15 January 1887 for £10, 24 August 1887, for £10, 4 March 1891 for £12,  and another.  Unfortunately, a piece down the side of the front page measuring 3.5 cm x 21 cm has been cut away and so this obviously affects the text of that page  Document signed by: Martha Elliott Witnesses: Edward M Underwood, John Harris

Paper Document - 1738 Deed - Ross, Herefordshire George II Period Document A paper document on one sheet measuring 21 cm x 33 cm approx Articles of Agreement for property in the town of Ross dated 27 October 1738.  The document is quite interesting as it is refers to a dwelling house with a shop and Alice Maddocks agrees in the document to enlarge the shop by moving the partition between the shop and the kitchen and there is also mention of altering the stairs and the glass for the windows Parties: Alice Maddocks (spelt in the document as Madox but signed as Maddocks), spinster, of Ross and James Clarke, mercer, of the City of Hereford Other names include: Mr Newman, surgeon Document signed by: Alice Maddocks, James Clark Witnesses: James Maddocks, James Maddocks Junr Condition: A little ragged round the edges and a split on one of the folds, but generally quite good for a paper document of this age.

E. Watters Esq., Lincolns Inn, London.  It has two post office stamps.  Has some damage where the seal has been broken.  It is on "B & T Sweetapple 1829" watermarked paper.

At this time when a woman married, any property she owned automatically passed to her husband.  If he wanted to sell such property, under common law his wife had to be part of the process, or to consent.  This was seen to prevent the husband abusing his position as owner of property gained through marriage.  The document was to show that the wife was of full age and understood the proceedings and agreed to the sale without being forced to. The need for such certificates was ended by the Married Womens Property Act of 1882.  This gave them the same rights as single or widowed women.

This particular deed was agreed by Mary White Nixon, wife of John White Nixon of Hereford, concerning property in the town of Ross in the County of Hereford. The Commissioners were William Powell Hooper and Henry Minett of the town of Ross. Also mentioned in this deed is Henry Thomas Burrell, Jane Sloane.

This appears to be a re-assignment of a 500 year mortgage between Jeremiah and Mary Shelton plus Alice Sheppard and Richard Horsnett after Horsnett defaulted. In 1768 he was identified as a brassfounder when he was made a burgess of Bridgnorth, in Shropshire, a few miles up the Severn. John Ingram probably lived in River House, on Riverside South in Bewdley, a dwelling which belonged to the Ingram family'

1767 Vellum indenture, Wigmore, Hereford & Seals. Location: A house with lands totalling at least 69 acres incorporating two gardens, four orchards, eight meadows and several other fields in Wigmore in Herefordshire. Persons Involved: Martha Millechamp and Samuel Millechamp

Contents: This indenture concerns the resolution to disputes between mother and son over the estate of Thomas Millechamp, their late husband/father. The indenture witnesses that Samuel will pay his mother a yearly annuity of six pounds together with 120 gallons of cider or an additional 25 shillings per year for life. Samuel in return gains all rights to the property that is described above. Details about the property are given including field names; land use, acreage and past and present tenants. The document closes with the agreement by both persons to cease any further claims against the other.

Henry VIII had made statue law to ensure that all freehold sales were made public so that the state would know who was in possession of freehold property at any one time. Leasehold however was exempt, thus those people wishing to keep the transaction private first created a Lease. The rent and length of the lease were usually nominal (normally five shillings and for a year) as this was simply a paper exercise. The following day a Release would be created with the information contained within it being factual as this was the actual sale.

1801 Vellum indenture, Leinthall Earls, Hereford & Seal. Persons Involved: Edward Ingram and Richard Moore and John Beebee Morris. Location: A house now divided into two houses with lands in Leinthall Earls, in parish of Aymestrey in Herefordshire.

Contents: This indenture concerns an assignment in relation to the above property. Whereby in 1769 Gilbert Moore buys one set of property in Leinthall Earls. Following his death in 1799, Richard Moore inherits part of it and purchases the remainder in 1800. At the same time he purchases another set of property in Leinthall Earls that had itself been recently partly exchanged for another set of lands also in Leinthall Earls. These combined two sets of lands are then partly sold to Thomas Monnington in 1801 and this indenture sees the remainder being assigned to John Beebee Morris as trustee of Richard Moore to attend the inheritance. Details about the persons involved are given including their occupations along with the amount of monies exchanged. There are partial recitals of indentures dated 1776 and 1800 respectively. FASCINATING HANDWRITTEN ENGLISH  VELLUM INDENTURE DATED 11TH OCTOBER, 1784. Document is written on vellum parchment in medieval formatted ink, signed also on verso. Land deed/lease agreement for Thomas Knolles Gosnell, of the Council of Shadwell,Middlesex (Stockbroker),  Thomas Shuter, St Luke, Middlesex (Gentleman), and Francis Majory, a wine merchant from Ludlow in the county of Salop .  Storage creases and a few minor edge tears but remains in great shape, ink nice and clean and edges with minimal wear, with two original wax seals and tax stamps intact with designs,  as shown. Also great calligraphic header. Measures 27” x 15”.
From the images the indenture relates to a sale of several properties from Gosnell and Shuter to Majery. One property is called Westybrook in Trubury? in the countyu of Worcester and was formerly in the occupation of Gilbert Cox, now of Thomas Reynolds and Thomas Bray. Ledbury Indenture Relating to Thomas Pantall and Boothall House. Ledbury, 1698.

A vellum indenture measuring twenty by fourteen inches (fifty-two by thirty-six centimetres) approximately. With nine tags (of which only seven have been signed) some of which have the remnants of the wax seals. Docketed on the reverse and the indenture has been folded.

Dated Nineteenth of July, 1698. This indenture is between William Wintour, Elizabeth Skipp, John Trist, John Phillips, Benjamin Pritchard, William Bissell, Edmond Rose, John Moreton, Anthony Robe and John Thorne on the one hand and Thomas Pantall on the other and relates to rents and income for Boothall House in Ledbury.

It would appear that this indenture is possibly an amendment of the indenture that hangs in the Painted Room in Ledbury (my thanks for information on that indenture to the always excellent Ledbury Portal site). From the transcript on that site it would appear that the name Richard Drewe is missing from our indenture. This removal may be the cause of the amendment.

Herefordshire Account Roll. Account roll of honour of Wigmore, 1387-88, manuscript document on vellum, some spotting and soiling, somewhat creased and rubbed with a little loss of legibility, 44 x 24 cm. Transcript included in the lot:

ACCOUNT ROLL of the honour of Wigmore in Herefordshire, being the account of John Chaundeller, bailiff of the liberty of Roger de Mortimer (de mortuo mari) and his fellow custodians (guardians) of the honour, for the period Michelmas 1387 to Michelmas 1388.
One membrane. Latin (with some English words for customary dues).

The honour of Wigmore was one of many of the possessions of the Mortimer Earls of March and Ulster. Edmund de Mortimer, Earl of March and Ulster, had died in 1381 and the castle, lordship and manor of Wigmore appears in his inquisitio post mortem (Calendar of Inquisitions Post Mortem 1-7 Richard II, p 227); his heir was his son Roger, a minor born in 1374. The wardship of his lands was granted to Richard Earl of Arundel and others in 1384 (Cal. Patent Rolls 1381-5, p 377; Thomas de Beauchamp, Earl of Warwick; Henry de Percy, Earl of Northumberland and John Lord Neville).
Roger de Mortimer was by the period of this account a figure of no small importance; he had been brought up as a royal ward and proclaimed heir presumptive, and in 1388 married the king's neice. Subsequently he accompanied Richard II to Ireland in 1394, became Lieutenant of Ireland 1397, grew in popularity and aroused the suspicions of Richard II, but was killed in Ireland in 1398.

The local place names in the area of the honour include Adforton ('Atforton'), Aymestry ('Ailmondestre'), Brampton ('Brompton': market there), Yatton ('Yetton') and Lye (a mill there); one entry refers to a filed called Neweton. next to the castle.

The most interesting entry refers to the customary dues called 'Solughsilver and Rapsilver' due from the vills of Adforton, 'Overliegh', 'Netherleigh', Yatton (each 2s 4d) and 'Wodehampton' (14d) due annually at Michelmas. These are dues in commutation for services in ploughing and reaping - ploughsilver and reapsilver. 'Repsilver' is known in the 13th century (OED) but the form  'Solughsilver' has not been found in the dictionaries. Sullow (=plough) is listed in the new OED, and the Middle English Dictionary has an extensive entry under  solou, with variants including solugh, and a number of combinations - solou (solugh)-silver is not one of them.

This account roll may thus make a modest addition to our knowledge of Middle English.
