This Indenture made the Second Day of
June in the ninth year of the Reign of Our Sovereign Lord George the Third by
the Grace of God King of Great Britain ffrance and Ireland Defender of the ffaith
and soforth in the year of our Lord One Thousand seven hundred and sixty nine Between Dod Jearvice now of Milton in the County of Somerset,
Yeoman, but late of Burnham in the said Country of the one part and Richard
Locke of Burnham aforesaid, Yeoman of the other part
Whereas the said Dod Jearvice by virtue of
a certain Indenture of Lease bearing date the tenth day of January which was in
the year of Our Lord One Thousand seven hundred and forty ffive of the grant of
Sir Richard Warwick Bampfyeld Baronet Assignment thereof and other assurances
in the Law now is and standeth Lawfully Intitlesd unto and possessed of a the
Messuage or Tenement Lands and Premises hereinafter mentioned for the residue
or remainder of a certain term of ffour score and nineteen years now
Determinable on the several dceases of John Moss of the City of Wells in the
said County Esquire and Elizabeth (late Hutson) now the wife of Joseph Sedgwick
of St Mary Aldermanbury in the City of London, Merchant, under the yearly rent
of nineteen shillings and sixpence and for an Herriott the best beast or Goods
of the Tenant in possession of the premises or the sum of Three and fifty
shillings and ffour pence in lieu thereof at the Election of the said Sir
Richard Warwick Bampfylde his Heirs or Assigns and other Covenants Reservations
and Agreements in the said Indenture of Lease mentioned referred and contained
And Whereas the said Richard Locke
hath agreed to purchase of and from the said Dod Jearvice all his right Estate
and Interest of and in the said premises [section at this point apparently
overwritten to make illegible or that had been left blank for additional
wording at the time of drafting and subsequently not needed] for the residue
and remainder of the said term of ffourscore and nineteen years Determinable as
aforesaid for the ffine of sum of One Hundred and Thirty pounds
Witness now therefore This present Indenture that the said Dod Jearvice for and
in consideration of the said sum of One
Hundred and Thirty pounds of lawful money of Great Britain to him in hand well
and Truly paid the Receipt whereof the said Dod Jearvice doth hereby
acknowledge and thereof and from every part thereof doth acquit Release and
Discharge the said Richard Locke his Executors Administrators and Assigns by
these presents hath Granted Bargained Sold Assigned
transferred and Setover and by these presents Doth Grant Bargain Sell Assign
Transfer and setover unto the said Richard Locke All that Messuage or Tenement
of Old Auster situate lying and being in Gosemoore in the Parish of Burnham in
the said County of Somerset and Twenty Acres of land, meadow and pasture (be it more or less) to the said Messuage
belonging with all and singular the Appurtenances formerly in the tenure of
John Daniel deceased whereof the house and hays contain ffour acres and half
lying between the Lands sometime in the tenure of John Mower on the West part
and the Lands sometime of Robert Cannington on the East part Three acres and
half in Langcroft between the Lands sometime in the tenure of John Cary on the
West side and the Lands sometime in the tenure of Robert Herring on the East
side ffour acres in Reedy Close between the Lands sometime in the tenure of
Robert Herring on the West side and the highway on the East side Two acres and
half in Edymead between the Lands sometime in the tenure of Augustine Board on
the South side and the Lands sometimes in the tenure of Thomas Moore on the
North side One acre and a half in Newnhams? between the Lands sometime in the tenure
of John Gee on the North part and the Lands sometime in the tenure of Joan Dod
on the South part One acre of meadow at Manmoore between the Lands sometime in
the tenure of John Gander on the Southside and the Lands in the tenure of John
Dod on the Northside Two Acres in Burnham moor at Millmote between the Lands
sometime in the tenure of Thomas Thorne on the Northside and a Close called
Cobbs Close on the southside One acre called Birds ffurlong between the Lands
soemtime in the tenure of Thomas Thorne on the West side and the Lands sometime
in the tenure of Thomas Moore on the East sidewith all such and so much Common
and Commons of pasture in Mark Moor otherwise Thurlemoor and also where as to
the said premises with the Appurts. Did of right belong And also all the Estate
Right Title Interest Term and Tenure of years Challenge Claim and Demand
whatsoever of him the said Dod Jearvice of in or to the said Messuage Tenement
or premises and every part and parcell thereof Together with the said …ted? Indenture of Lease and all other Deeds and writings that concern
the said premes. Or any part thereof now in the hands or Power of the
said Dod Jearvice or which he can come at or obtain
without Suit at Law or Equity
To have and to hold the said Messuage or
And the said Dod
Jearvice for himself his Extors. Admors. & Assigns Doth covenant promise and Agree to and with the said
Richard Locke his Extors. Admors. & Assigns
by these presents in manner and form following, that is to say, that for and
notwithstanding any Act matter or thing by him the said Dod Jearvice done
committed or wittingly or willingly suffered to the contrary the said Rented
Indenture of Lease is a good and sufficient Demise and Lease Valid in the law
of and for the said Messuage or Tenement Lands and premises mentioned or
intended to be hereby Assigned not forfeited unsurrendered or otherwise void or
avoidable And also that the said Dod Jearvice have at the time of the Ensealing
and Delivery of these presents in himself good Right full Power and lawfull
Authority to bargain sell and Assign the said Messuage Tenement Lands &
premises mentioned or intended to be hereby Assigned with their Apprts. Unto the said Richard Locke his Extors. Admors.
& Assigns for the residue of the said term of ffour score and nineteen
years Determinable as aforesaid
And further that it shall and may be
lawful to and for the said Richard Locke his Extors. Admors.
& Assigns from time to time during the Continuance of the said Term of
ffour score and nineteen years peaceably & quietly to possess and enjoy the
said
And moreover that the said Dod Jearvice his Extors. Admors.
and Assigns and all and every Other Person and Persons having or lawfully
claiming or which shall or may have or lawfully claim any Estate Right Title or
Interest either in law or equity of in to or out of the said Messuage Tenement
Lands and premes. mentioned to be hereby Assigned or any part thereof shall and
will from time to time & at all times hereafter during the Continuance of
the said Term of ffour score and nineteen years Determinable as aforesaid upon
the reasonable Request & the Cost and Charges of the sd. Richard Locke his
Extors. Admors. or Assigns make do & execute or
cause to be made done & executed all & every such further & other
lawful & reasonable Acts Deeds & things Conveyances & Assurances in
the Law Whatsoever for the further and better Assigning & Conveyancing of
the said Messuage Tenement Lands & premes. mentioned
to be hereby Assigned with their Appurts. unto the said
Richard Locke his Extors. Admors. & Assigns for
and During the said Term of ffour score and nineteen
years Determinable as aforesaid as by the said Richard Locke his Extors. Admors. & Assigns or his or their Counsel learned in the
Law shall be reasonable advised devised and required
